<![CDATA[     			                                               		                       	                                                                                 					                                                                                                	                     <p><img src="http://www.amny.com/images/branding/masthead_home.gif" border="0" width="471" height="89" />&nbsp;</p><p><span class="story-byline">By Matthew Sweeney Published: </span><span></span><span class="story-titleline"></span>July 15, 2008<span class="story-dateline"></span></p>                       		                                                                                            <div id="story-body-parent">             <p id="story-body" style="clear: left">When they look at its nearly vacant building at Jay and Willoughby streets in <span class="taxInlineTagLink">Downtown</span> Brooklyn, some critics of the MTA see an opportunity to help fund the cash-strapped agency.<br /> <br /> With another possible fare hike looming as the agency faces soaring budget deficits, the MTA could save about $100 million if it sells or leases eight floors of the 13-story building on 370 Jay Street, a group of elected officials say.<br /> <br /> &quot;With the agency facing a capital budget deficit and straphangers continuing to wait for long-promised service improvements, the MTA ought to be leveraging valuable real estate for profit, not letting it sit empty and unused,&quot; City Councilman David Yassky (D- <span class="taxInlineTagLink">Manhattan</span>) said.<br /> <br /> When the MTA board meets next week, it is expected to take some significant steps to cover its budget shortfalls. The agency may propose a fare hike next year to cover the $500 to $700 million hole in its operating budget. And the MTA board is expected to approve $2.7 billion in cuts to subway station repairs and other work as it amends its capital budget for 2005-09.<br /> </p></div><div class="rail"><p id="story-body2">&quot;We&#39;re watching and we&#39;re worried,&quot; said Gene Russianoff, senior staff attorney for NYPIRG&#39;s Straphangers Campaign, considering the possibility of an MTA fare hike proposal next week.<br /><br /> The MTA is planning to spend some $150 million from its capital budget over the next several years to renovate and reoccupy the former <span class="taxInlineTagLink">NYC Transit</span> headquarters above the Jay Street station.<br /> <br /> The MTA says that it will save money in the long term by consolidating back office space from other leased properties at the building.<br /> <br /> &quot;At a time when the MTA is scrambling to balance its budget -- with possible fare hikes and service cuts -- it should not waste its resources on building back office for MTA operations,&quot; said Joe Chan, president of the Downtown Brooklyn Partnership. &quot;They should allow the private sector to step forward and turn what could be a cash drain into a revenue generator.&quot;<br /> <br /> Some city and state officials and the Downtown Brooklyn Partnership argue that by selling the building or leasing some of its floors the MTA could save $100 million to fund the repair of stations or make other improvements in its capital budget.<br /> <br /> Two City Council members and two state Assembly members from Brooklyn have written to former MTA chairman Richard Ravitch to argue that the authority reconsider its plans for the building. Ravitch was appointed by Gov. <span class="taxInlineTagLink">David Paterson</span> to run a commission charged with finding new sources of funding for the MTA. The Ravitch Commission is expected to have suggestions by Dec.5.<br /> <br /> The letter to Ravitch points out that the MTA&#39;s plan would leave 370 Jay Street, already vacant for several years, largely unoccupied until 2016.<br /> <br /> The MTA says it can&sup1;t sell the building because the city owns it, and there&sup1;s no space to lease. A source familiar with the building said in the past, the city has put forward the idea to the MTA of selling it.<br /> <br /> &quot;We need the whole building,&quot; MTA spokesman Jeremy Soffin said in an e-mail. &quot;We are emptying the building as we find space so that it can be fully renovated. David, too, was pleased when the Department of Corrections decided to cut costs by moving BHOD inmates to Riker&#39;s Island.</span></font></p><p><font face="Arial" size="2"><span style="font-size: 10pt; font-family: Arial">Since that time, Downtown Brooklyn has exploded with new development, becoming one of the fastest growing residential and business districts in the entire City.</span></font></p><p><font face="Arial" size="2"><span style="font-size: 10pt; font-family: Arial">But now, just when things are going well for Downtown Brooklyn, the Department of Corrections is threatening to reopen the BHOD and double its size through a costly renovation that will hurt development and impact the character of the neighborhood.</span></font></p><p><font face="Arial" size="2"><span style="font-size: 10pt; font-family: Arial">David is working with community members and other elected officials to stop this senseless expansion. <title>City&apos;s Film, TV Production Suffers as Actor Strike Looms (The Sun New York)</title>

font-family: Arial">Because a nationwide strike could be called within the next several weeks, much of the city&#39;s film and television production has ground to a halt, producers and union leaders said. Filmmakers are reluctant to begin costly shooting schedules when there is a chance they will be interrupted.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">&quot;Business could be quiet for a while,&quot; Douglas Steiner, the president of Steiner Studios, one of the city&#39;s largest production facilities, said.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">Even as the city&#39;s acting community gears up for a fight with the studios, however, its local union leaders are rebelling against their superiors in <a href="http://www.nysun.com/related_results.php?term=Hollywood" title="Hollywood">Hollywood</a>, accusing them of dragging New York into an irrationally aggressive negotiating strategy.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">The Hollywood leadership of the Screen Actors Guild is holding out for better pay and a bigger share of profits from the Internet. Screen Actors Guild officials in New York are claiming that the Hollywood negotiators are hijacking the union&#39;s agenda.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">The secretary of New York Screen Actors Guild division, Sue-Anne Morrow, said in an interview that New York is becoming the victim of a fight it doesn&#39;t want.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">&quot;Unfortunately, the Hollywood members have the majority of votes on the national board,&quot; Ms. Morrow said. &quot;We were hamstrung in our efforts to protect and serve all performers nationwide.&quot;</span></p>  <p><span style="font-size: 10pt; font-family: Arial">New York</span><span style="font-size: 10pt; font-family: Arial"> actors may be more willing to compromise because they tend to be &quot;Jack of All Trades,&quot; Ms. Morrow suggested, pursuing a hodgepodge of TV, theater, and film roles that are governed by multiple contracts.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">The Screen Actors Guild Hollywood office did not respond to repeated requests for comment.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">Despite the opposition among New York&#39;s labor leaders, union members on the ground appeared to be prepared to strike. In half a dozen interviews conducted on the set of &quot;When in Rome,&quot; a movie filming near City Hall this week, cast members overwhelmingly supported the Screen Actors Guild&#39;s tough stance.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">&quot;We&#39;re negotiating for our future, not just for today,&quot; a background actor on the set, Marti Vendetti, said.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">If an official actors&#39; strike does occur, it may further stunt the growth of an industry that has ballooned in New York during the last several years. Filming activity in the city more than doubled between 2002 and 2006, contributing $5 billion to the economy annually and employing 100,000 people, according to the Mayor&#39;s Office of Film, Theatre &amp; Broadcasting. That is because the office building allows him to bring his bike upstairs and stash it in a walk-in closet alongside bikes belonging to three or four co-workers.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">&ldquo;It&rsquo;s one less problem for me,&rdquo; Mr. Martinez said. &ldquo;At least I know my vehicle is O.K., so I&rsquo;m pretty sure I can get back home safely.&rdquo;</span></p>  <p><span style="font-size: 10pt; font-family: Arial">It may seem like a simple sentiment, but having a safe place to store a bike at work is an urban amenity that ranks somewhere with having unfettered roof access or a key to a community garden. While people are generally free to wheel their bikes in and out of residential buildings, commercial buildings often ban them.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">At a time when, city officials say, the number of people cycling in New York is soaring and the city has been implementing a plan to create 200 miles of new bike lanes, one glaring problem for those who want to cycle to work is the shortage of parking, particularly in areas like Midtown Manhattan. </span></p>  <p><span style="font-size: 10pt; font-family: Arial">&ldquo;It&rsquo;s one of the biggest missing links preventing New York from being a world-class bicycling city,&rdquo; said Wiley Norvell, a spokesman for Transportation Alternatives, an advocacy group that promotes bicycling. &ldquo;It&rsquo;s the No. 1 reason that serious, savvy cyclists don&rsquo;t use their bikes to get to work.&rdquo; </span></p>  <p><span style="font-size: 10pt; font-family: Arial">In a city inhabited by bike thieves so crafty and notorious that the bicycle lock company Kryptonite calls one of its locks the New York Fahgettaboudit, many people are loath to leave a bike chained outside, where it can be stolen or quickly stripped of parts. So riders who are not as fortunate as Mr. Martinez end up improvising.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">Some commuters, who park on the street, try to throw off thieves by choosing a different spot each day or by moving their bike during lunch. Others depend on the good will of local business owners who might be willing to squeeze a bike into a shop corner at no charge.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">Even for those willing to park outdoors, space is limited. Although it is common for people to secure bicycles to signposts or parking meters, Seth Solomonow, a spokesman for the city&rsquo;s Transportation Department, said that it is a violation of a city ordinance to lock a bike to anything other than a bicycle rack. In addition, many businesses and buildings post signs warning cyclists not to chain their bikes to fences or railings.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">Transportation Alternatives estimated that 131,000 people ride bicycles daily in New York City. </span></p>  <p><span style="font-size: 10pt; font-family: Arial">Mr. Solomonow said there were about 5,000 bike racks in New   York City. In addition, he said, the city has recently installed four special bike sheds &mdash; one each in Manhattan, Brooklyn, the Bronx and Queens &mdash; that resemble bus shelters and provide covered space for up to eight or nine bikes. The city expects to have 37 shelters installed at transit hubs by the end of the year.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">Mayor <a href="http://topics.nytimes.com/top/reference/timestopics/people/b/michael_r_bloomberg/index.html?inline=nyt-per" title="More articles about Michael R. Bloomberg.">Michael R. Bloomberg</a>&rsquo;s plan for a sustainable future, which he introduced 15 months ago, included provisions to install 1,200 new bike racks by 2009 and to require large commercial buildings to provide bike storage.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">Similar measures have been advocated by <a href="http://topics.nytimes.com/top/reference/timestopics/people/y/david_yassky/index.html?inline=nyt-per" title="More articles about David Yassky.">David Yassky</a>, a city councilman from Brooklyn, who wrote a bill calling for every commercial building in the city to provide bike parking on or near the premises. So far the proposal has not received a hearing.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">&ldquo;The clear majority of office buildings do not permit bicycles,&rdquo; Mr. Yassky said. &ldquo;If a company is willing to make room for people to bring bikes in, it makes no sense for the commercial landlord to prohibit it.&rdquo;</span></p>  <p><span style="font-size: 10pt; font-family: Arial">A few people who work in office buildings have successfully negotiated with landlords or managers to allow bicycles inside; others have had less luck. April Greene, a program assistant at a nonprofit art foundation that used to be housed at Rockefeller Center, said that when she worked there, she sent letters to the complex&rsquo;s management, Tishman Speyer, broaching the subject of allowing bikes inside.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">&ldquo;I rallied about a dozen other bike commuters,&rdquo; she said. &ldquo;They refused to meet with us.&rdquo;</span></p>  <p><span style="font-size: 10pt; font-family: Arial">But management companies often say that office buildings were not designed to accommodate bicycles.</span></p>  <p><span style="font-size: 10pt; font-family: Arial">&ldquo;Bicycle racks are available outside for the convenience of bike riders,&rdquo; said Maya Israel, a spokeswoman for Tishman Speyer. &ldquo;Bicycles are not permitted inside, for the safety of all our tenants and visitors.&rdquo;</span></p>  <p><span style="font-size: 10pt; font-family: Arial">Some commuters, like Jamie Fisher, a futures broker in Midtown who bicycles 25 miles from Glen Rock, N.J., have relied on creativity to keep their bikes secure. For a time, the manager of a parking garage kept Mr. Fisher&rsquo;s bike inside the garage office for free. Now, a newspaper vendor with a storefront allows him to store his bike in the shop&rsquo;s basement. </span></p>  <p><span style="font-size: 10pt; font-family: Arial">Robert Kotch, who regularly commutes from New Jersey with Mr. Fisher, has found himself playing host to four or five of what he calls &ldquo;bike refugees&rdquo; &mdash; friends who ride to work but have no place to park. <![CDATA[  <p class="copyright"><img src="http://www.brooklyneagle.com/images/bde_logo.gif" border="0" width="471" height="67" />&nbsp;</p><p class="copyright"><span class="f24"><strong>Downtown Mobilizes To Stop Jail Expansion</strong></span></p>  <p class="copyright">By DENNIS HOLT Published <span class="blue">June 23, 2008</span></p>  <p class="MsoNormal"><strong>Upcoming Meeting To Feature Yassky, Other Elected Officials</strong></p>  <p>BROOKLYN &mdash; The challenge to the city proposal&rsquo;s to double the size of the Brooklyn House of Detention by building a second building comparable to the existing one has intensified and is becoming a comprehensive political issue.</p>  <p>On Thursday, June 26, City Councilman David Yassky will host a press conference at 12:30 p.m. at the House of Detention on Atlantic Avenue to protest the city plan. He is expected to be joined by several other elected officials including Councilman Bill de Blasio and city Comptroller William Thompson. Although elected officials have voiced opposition to the jail proposal before, this press event is the first overt political step. It is anticipated that comments, and perhaps proposals will be made about an existing $500 million capital line in the city budget to build the jail expansion.</p>  <p>The House of Detention was closed in 2003 and is still closed, with prisoners being transferred to Rikers  Island. This effort failed because of conditions there and because the city did not invest money to improve them.</p>  <p>The current Brooklyn facility has a capacity of more than 700 beds, and the new proposal would enlarge that capacity to about 1,500 beds. A building about the size of the current facility will need to be built.</p>  <p>Community opposition has been building for more than a year. A group calling itself the Stakeholders Group has existed for some time. It is composed of the Boerum Hill Association, the Cobble Hill Association, the Atlantic Avenue LDC, the Atlantic Avenue Betterment Association and tenants from some of the new apartment complexes in the area.</p>  <p>Last week, a new group was formed, largely, but no means entirely from new homeowners on State Street in Boerum Hill. A meeting was held on Saturday, June 14, and by Sunday afternoon storefronts all over Smith   Street, Court Street and Atlantic Avenue were festooned by stark posters featuring the command &ldquo;Stop the Jail.&rdquo;</p>  <p>The more than 30 people attending this meeting were divided into teams that then canvassed the neighborhood, both commercial and residential buildings and did so. Calling themselves Stop the House of Detention, the constituency includes more than just homeowners.</p>  <p>One of them is Jim Walden who is a member of the Manhattan law firm Gibson, Dunn and Crutcher. This firm went to court to stop a similar plan to build a new house of detention in the Bronx at Oak Hill. That effort was a success.</p>  <p>One of the issues this group is focusing on is the city&rsquo;s decision that it does not have to go through the city land use review process to double the size of the jail. <![CDATA[  <p class="MsoNormal"><img src="http://www.brooklyneagle.com/images/bde_logo.gif" border="0" width="520" height="74" /> </p><p class="MsoNormal"><br /><span class="f24"><strong>New Rules, Technology Will Make City&rsquo;s EnvironmentalControl Board Fairer for Street Vendors </strong></span></p>  <p class="MsoNormal">By BROOKLYN EAGLE Published: <span class="blue">June 17, 2008</span></p>  <p>New rules and 21st century technology are designed to make the Environmental Control Board (ECB) more equitable and efficient for small business street vendors.</p>  <p>&ldquo;Small businesses are the backbone of New   York City, and we need to do what we can on the local level to keep them working, creating jobs and fueling our economy,&rdquo; said City Council Speaker Christine Quinn in a press release. &ldquo;By bringing the Environmental Control Board&rsquo;s operations into the 21st century and making the proceedings fairer and more efficient, we&rsquo;re helping ECB live up to its mission &mdash; improving quality of life for everyday New Yorkers.&rdquo;</p>  <p>Quinn and Council Members James Gennaro, Simcha Felder, David Yassky, Leroy Comrie and Thomas White, have introduced legislation with reforms that will upgrade technological services, add foreign language capability, improve compliance, speed up the process and increase the board&rsquo;s independence.</p>  <p>Currently, small business owners who receive notices of violation often have to make multiple trips to ECB hearings or simply plead guilty to the charge because cases do not move forward unless agency witnesses are present. The process is further complicated by a lack of clear rules governing the presentation of relevant pieces of evidence (i.e. documents, lists of witnesses, etc.). In addition, ECB currently has only limited translation capability.</p>  <p>Established in 1972 as part of the Department of Environmental Protection, the ECB has evolved into the city&rsquo;s second largest administrative tribunal that receives approximately 700,000 cases per year, including code enforcement and quality of life violations, and handles about 175,000 hearings a year, which are conducted in five borough offices.</p>  <p>&ldquo;I am keenly aware that the issue of complying with food vendor codes has proven to be a difficult process, especially for new immigrants,&rdquo; said Consumer Affairs Committee Chair Leroy Comrie. &ldquo;Today&rsquo;s reform proposals, especially with respect to the improvement of translation services and compliance standards, will be helpful in addressing the bureaucratic red tape that our city&rsquo;s food vendors face when they are dealing with the Environmental Control Board.&rdquo; </p>  <p>&copy; Brooklyn Daily Eagle 2008 All materials posted on BrooklynEagle.com are protected by United States copyright law. Of that figure, it has been disclosed that the City Council annually allocates millions of dollars to phantom organizations to create a slush fund of discretionary spending with very little oversight.</p>  <p>The speaker of the City Council, <a href="http://www.nysun.com/related_results.php?term=Christine+Quinn" title="Christine Quinn">Christine Quinn</a>, is under scrutiny over budgetary irregularities. Ms. Quinn has claimed it took her a while even to figure out how cash was allocated. If city money is a mystery to Ms. Quinn, it&#39;s also a mystery to the rest of us. For example, we now know that some Council members, such as Kendall Stewart, signed forms denying conflicts of interest with regard to organizations they wanted to fund; now two of Mr. Stewart&#39;s aides have been indicted for allegedly embezzling $145,000 from a city funded organization on his list.</p>  <p>Speaker Quinn proposed some reforms, such as making sure the organizations requesting funds actually exist; having an &quot;independent&quot; compliance officer examine the requests; and putting the groups calling for funding on the Web. In response, on June 4 the city announced that the Department of Investigation will verify the existence of each entity receiving more than $5,000. The new rules impact the $360 million spent by the Council on discretionary items, but leave untouched the much greater amounts spent on infrastructure and other projects, and do not go far enough.</p>  <p>The whole controversy makes painfully clear the potential for corruption in the city budget; each day brings new disclosures of how unaccountable phantom organizations have been increasing budget line items for years. Even <a href="http://www.nysun.com/related_results.php?term=Michael+Bloomberg" title="Michael Bloomberg">Mayor Bloomberg</a> has come under scrutiny. The City Council looks like it is buying votes, and doing so without accountability.</p>  <p>New York City would benefit from taking a cue from the federal government and the 11 state governments that have employed a new weapon in the war against wasted public spending: posting the government&#39;s actual check register in its entirety on the Web. This movement has found broad, bipartisan support.</p>  <p>Note, for example, the Transparency Act of 2006, which went into effect this year, and which was sponsored by Senators Coburn and Obama. Today the Federal Budget is online as a result of this act and posted at USASpending.gov. Recently, the same two senators joined forces on June 4 to propose the Strengthening Transparency and Accountability in Federal Spending Act of 2008, which would enhance the Web site to include more information and make it more easily searchable.</p>  <p>On the state level, Texas is at the forefront of this revolution, disclosing expenditures as little as $43. And the Texas Education Agency now posts all actual expenses on line. As a result, Texans know almost down to the penny how much was spent with which vendors each year, and their state budget is coming under real control. New York&#39;s budget would benefit from such control. New   York State faces a slowing economy &mdash; one with a budgetary deficit forecast by the governor to be $4.8 billion in 2008-2009.</p>  <p>New York State has started down the road toward more transparency on the Web. Thanks to Attorney General Cuomo, who launched &quot;Project Sunlight&quot; last year, New   York posts some state contracts on the Web and identifies who sponsored which bills and who lobbied for them. And last month, as part of his Program to Eliminate the Gap in the state budget, Governor Paterson announced a plan to put summary State Department budget plans on the Web, characterizing the action as an important first step to budget transparency.</p>  <p>Seeking to establish credibility in his new role, the governor has created working groups to find budget cuts and he has launched a statewide economic development fund. He should also immediately take the next step towards transparency and move to put the entire state check register on line for the public to study. I am sure we would learn a lot. Speaker Silver and State Senator Bruno should welcome this change, and ratify it in the Assembly and the Senate &mdash; although this can be done just by Executive Order in the same way PEG and Project Sunshine were started.</p>  <p>Mr. Bloomberg is an information age entrepreneur who has made billions of dollars in the private economy by getting timely information at the speed of light to Wall Street. I cannot think of anyone more qualified to bring this revolution to New York City, thereby leaving his personal stamp on the bureaucratic behemoth New York City has become.</p>  <p>Imagine the opportunity for self-awareness on the part of New York City if all expenditures, including those as little as $43, were on the Web for anyone to review. Mr. Bloomberg should implement this quickly, taking advantage of the public outrage in response to the slush fund scandal, and ask a chastened City Council to join him in supporting a city run more openly and honestly.</p>  <p>The City Council needs to act to restore its credibility. If the older generation is reluctant to act, newer figures such as Councilman David Yassky, who is running for comptroller, can take the lead. With a Web trail, the Council would be less inclined to be fiscal libertines. The mayor should act because he knows it is the right thing to do.</p>  <p>To quote the Supreme Court, &quot;sunshine is the best disinfectant.&quot; In New York City, where the average municipal employee makes more than $50,000 per year &mdash; and roughly 20% of the work force works for the government &mdash; transparency and accountability are essential. If Texas can get the people&#39;s transactions on the Web, certainly Mr. Bloomberg can too.</p>  <p><em>Mr. Singer is an investment advisor in New York City.</em></p>  <!-- CONTENT END --><p>&nbsp;</p>]]>

<![CDATA[  <div class="Section1">  <p class="MsoNormal">November 26, 2007</p><p class="MsoNormal">&nbsp;</p>    <p class="MsoNormal">Chancellor Joel Klein</p>  <p class="MsoNormal">New York City Department of Education</p>  <p class="MsoNormal">52 Chambers Street</p>  <p class="MsoNormal">New York, NY 10007</p>  <p class="MsoNormal">&nbsp;&nbsp;</p>  <p class="MsoNormal">Dear Chancellor Klein:</p>    <p class="MsoNormal">We are writing to enlist your help in continuing the success of our local elementary school PS 8 (The Robert Fulton School) in District 13, serving Brooklyn Heights, Concord Village, Dumbo, Farragut Houses, Fulton Ferry Landing, Vinegar Hill &ndash; communities that lie adjacent to a rapidly growing Downtown Brooklyn.</p>    <p class="MsoNormal">As you certainly know, just five short years ago PS 8 was on the verge of being closed. Student enrollment had declined to a low of 150, zoned and out-of-zone parents were not choosing to send their children to the school, and the staff was demoralized.</p>    <p class="MsoNormal">In 2003, thanks to Mayor Bloomberg and yourself, Carmen Farina brought new leadership to PS8. Principal Seth Phillips and curriculum development specialist Olivia Ellis rolled up their sleeves and turned the school around. Enrollment and parent satisfaction soared. A magnet grant brought in many more families. In only four years, PS 8&rsquo;s enrollment has almost tripled. </p>    <p class="MsoNormal">PS 8 became a role model for the City --- the place to pilot new programs and showcase the new direction from Tweed. In a true partnership with the community, PS 8 provided an example of what any elementary school in the City could do. So much so that the school is now the &lsquo;victim of its own success&rsquo;. </p>    <p class="MsoNormal"><u>Today</u>, the second and third grades are overcrowded with 30 children to a class. The Science Room has been dismantled to add an additional fifth grade. Next year, our two pre-K classes will be eliminated to accommodate increased enrollment in the upper grades.<span>&nbsp; </span>If we had the space, we could fill no fewer than four pre-K classrooms with zoned children.<span>&nbsp; </span>Expected 2008 enrollment for grades K-5 exceeds our current building&rsquo;s capacity.<span>&nbsp; </span>Last year there were 26 graduating fifth graders. In 2010 there will be 92.</p>    </div>  <span style="font-size: 12pt; font-family: &quot;Times New Roman&quot;"> </span>  <p class="MsoNormal">We should be applauding, and we are.<span>&nbsp; </span>But that&rsquo;s not all.<span>&nbsp; </span></p>    <p class="MsoNormal">PS8 fifth graders face inadequate and limited choices as they search for middle schools in District 13.<span>&nbsp; </span>Even though we are told of underutilized schools in the District, most of these schools are deemed unacceptable for both academic and safety reasons. In short, while our elementary school success has us bursting out of our 37 Hicks Street building, with inadequate space to handle demand for elementary grades, it is all happening before any of the new buildings in the PS 8 zone are built. Like it or not, there simply are not enough good middle schools of choice to serve current and prospective families in Brooklyn&rsquo;s District 13.</p>    <p class="MsoNormal">Although we are aware that the Board of Education has predicted declining enrollments for District 13 middle schools, we respectfully question these assumptions on two grounds. </p>    <p class="MsoNormal"><em><u>First</u>, <span style="color: black">the Downtown Brooklyn Partnership reports that 14,000 residential units (housing approximately 35,000 people) are slated to be built in downtown Brooklyn over the next five years</span></em><span style="color: black">. This does not include housing at 360 Furman Street (aka 1 Brooklyn Bridge Park), which will open at the end of this year, nor the other residential buildings due to be built on the edge of Brooklyn Bridge Park. It also does not include the newly converted condos in the former telephone company building on Willoughby Street zoned for PS 8.<span>&nbsp; </span><em>Most of this new development is occurring in District 13</em> <em>and in an area that doesn&rsquo;t currently contain any</em> <em>middle schools</em>. (See enclosed map.) Outdated census data of the area shows a population in the mere hundreds.</span></p>    <p class="MsoNormal"><u><span style="color: black">Second</span></u><span style="color: black">, successful schools attract students and will <u>always</u> increase overall enrollment. There is no question that parents vote with their feet. Witness this at PS8 where parents who might have moved out of the City resolved to stay and help to build a diverse and awesomely energetic PTA. </span></p>    <p class="MsoNormal"><span style="color: black">Chancellor Klein, you of all people know that PS 8 became the poster school for Mayor Bloomberg&rsquo;s improvements at the Department of Education. Thanks to excellent leadership, the larger community around PS 8 has embraced the school.<span>&nbsp; </span>However,<span>&nbsp; </span>for PS 8 to remain successful, the Department of Education <u>must</u> address current overcrowding in the elementary grades. We appeal to you not only to allow Pre-K to remain, but also to provide good middle school options for graduating fifth graders. If not, PS 8 <u>and</u> District 13 will be losing hard working, tax paying families to the suburbs.<span>&nbsp; </span></span></p>    <p class="MsoNormal">We are currently searching for a facility to solve both these problems.&nbsp;We have identified a site that is only steps away from PS 8 at 72 Poplar Street. Formerly, the city-owned Police Department&rsquo;s Internal Affairs Building, which comes with a two-story garage, 72 Poplar was sold at auction to a developer who has informed us that he cannot develop it profitably as a residential building. It is available for long term leasing by a community facility. The owner has informed the Brooklyn Heights Association that his preference would be a net lease with the Department of Education, and that the property has been certified as asbestos free. The Brooklyn Heights Association&rsquo;s President who is an architect has drafted a floor plan indicating that the space can work for additional lower grades as well as an upper school.<span>&nbsp; </span></p>    <p class="MsoNormal">We are asking for your support in these efforts by taking two steps: Specifically,&nbsp;1) We would like the School Construction Authority to evaluate 72 Poplar Street for it&rsquo;s potential to meet PS 8&rsquo;s capacity needs as we have outlined them in this letter.<span>&nbsp; </span>2) We would like to show our draft plans to someone at the SCA as soon as possible before someone else signs a lease for these empty buildings. If, after an on-site inspection, the SCA finds the property to be unsuitable, we ask you to support us in identifying another site. </p>    <p class="MsoNormal">Please take notice of the signatories to this letter. They represent the trust and collaboration between school staff, families, neighborhood associations, community-based organizations, politicians and your administration. With much of the new population consisting of young families, the need for a school is now becoming desperate. David has been meeting with various members of the Department of Education and the Bloomberg administration for quite some time, but so far, the City has refused to act.</span></font>&nbsp;</p><p><font face="Arial" size="2"><span style="font-size: 10pt; font-family: Arial">Last September David formed a special task force of PS 8 parents and civic leaders to help build community support for a middle school and to explore possible locations. Since then, the task force has produced its own report, confirming what David, Comptroller William C. Thompson and many others have also publicly acknowledged: the City has failed to plan appropriately for growth in Downtown Brooklyn, and today it is refusing to accommodate schoolchildren in the area.</span></font></p><p><font face="Arial" size="2"><span style="font-size: 10pt; font-family: Arial">The DOE is slow to act, but we won&#39;t give up.
